These Terms govern your use of Rivex, a non-commercial research platform. Please read them carefully before using the platform.
1. Acceptance
These Terms of Service ("Terms") govern your use of Rivex ("the Platform"). By accessing or using the Platform, you ("User", "you", "your") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Service Description
Rivex is a data aggregation and information platform that collects, processes, and displays publicly available and licensed third-party data relating to energy commodity markets. The Platform provides price data, market analytics, AI-generated content, storage and flow data, vessel tracking information, and other market-related information for informational purposes only.
Rivex is not a trading platform, brokerage, exchange, or financial services provider of any kind.
3. Non-Commercial Research Project
Rivex is provided free of charge as a non-commercial research project. There are no subscription fees, free trials, auto-renewals, or payment processing. Access is by invitation only. Rivex reserves the right to revoke access, change features, or discontinue the platform at any time.
4. Acceptable Use
You agree not to:
- Scrape, harvest, or systematically extract data from the Platform by automated means
- Redistribute, resell, license, or sublicense any data or content from the Platform to third parties
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or algorithms of the Platform
- Use the Platform for any unlawful purpose or in violation of applicable regulations
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure
- Interfere with or disrupt the integrity or performance of the Platform
- Share your account credentials with any third party
5. Intellectual Property
Rivex content, code, design, user interface, and visual identity are protected by copyright and other intellectual property laws.
Pilot users receive a non-exclusive, revocable, non-transferable licence to use the Platform for personal evaluation purposes during the research period. No part of the Platform may be reproduced, modified, distributed, or used in any commercial manner without prior written consent.
6. Financial Disclaimer
RIVEX IS NOT A LICENSED FINANCIAL ADVISOR, INVESTMENT FIRM, BROKER, DEALER, OR REGULATED ENTITY OF ANY KIND. ALL INFORMATION IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.
COMMODITY TRADING AND DERIVATIVES TRADING INVOLVE SUBSTANTIAL RISK OF LOSS AND MAY NOT BE SUITABLE FOR ALL INVESTORS. PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. USERS ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL THEIR OWN TRADING AND INVESTMENT DECISIONS. RIVEX ACCEPTS NO RESPONSIBILITY OR LIABILITY OF ANY KIND FOR ANY TRADING LOSSES, FINANCIAL LOSSES, OR ANY OTHER LOSSES ARISING FROM USE OF OR RELIANCE ON INFORMATION PROVIDED ON THIS PLATFORM.
7. Data Accuracy Disclaimer
ALL DATA IS SOURCED FROM THIRD-PARTY PROVIDERS AND MAY BE DELAYED, INCOMPLETE, INACCURATE, OR UNAVAILABLE AT ANY TIME. RIVEX SHALL NOT BE LIABLE FOR ANY ERRORS, OMISSIONS, INTERRUPTIONS, DELETIONS, DEFECTS, OR DELAYS IN OPERATION OR TRANSMISSION OF DATA.
DO NOT RELY SOLELY ON RIVEX DATA FOR ANY TRADING, INVESTMENT, OR BUSINESS DECISION.
8. Third-Party and Trademark Disclaimer
ALL THIRD-PARTY TRADEMARKS, SERVICE MARKS, TRADE NAMES, PRODUCT NAMES, LOGOS, AND COMPANY NAMES MENTIONED ON THIS PLATFORM ARE THE PROPERTY OF THEIR RESPECTIVE OWNERS. THEIR MENTION DOES NOT IMPLY ANY AFFILIATION, ENDORSEMENT, OR PARTNERSHIP WITH RIVEX.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the total aggregate liability arising from or related to these Terms or your use of the Platform is limited to CHF 0 (zero), reflecting that Rivex is provided free of charge as a non-commercial research project.
Rivex shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or any other intangible losses, even if Rivex has been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Rivex, its licensors, and data providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to your use of the Platform, your violation of these Terms, or your violation of any applicable law or regulation.
11. Service Availability
Rivex does not guarantee uninterrupted, error-free, or continuous availability of the Platform. The Platform may be subject to scheduled maintenance, unscheduled downtime, interruptions beyond our control, or full discontinuation at any time. Rivex shall not be liable for any damages arising from service unavailability.
12. Account Termination
Rivex may suspend or terminate your account and access to the Platform at any time, with or without notice, including (without limitation) if you violate these Terms or engage in conduct that, in Rivex's sole discretion, is harmful to the Platform, other users, or the research project itself.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict-of-law principles.
14. Changes to These Terms
These Terms may be modified at any time. At least 30 days' notice of material changes will be provided by email or by prominent notice on the Platform. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
